The Fast-Track Appeal Process Step by Step

Step 1: Get the Discharge Notice in Writing

The hospital must give your parent "An Important Message from Medicare" (Form CMS-10065) at least two days before the planned discharge. If your parent is in a skilled nursing facility, they'll receive a Notice of Medicare Non-Coverage (NOMNC).

Do not sign anything that says you agree with the discharge decision.

Step 4: Acentra Health Conducts the Review

An independent physician at Acentra Health reviews your parent's medical records. This is not someone employed by the hospital making the decision. The review typically takes one business day after all records are received.

Step 5: The Decision

If Acentra Health agrees the discharge is premature, your parent stays. The hospital must revise the care plan.

If Acentra Health upholds the discharge, your parent becomes financially responsible for the hospital bed starting at noon on the day after the decision. You can still escalate to a second-level appeal through the Qualified Independent Contractor (QIC).

What Happens to the Bill During an Appeal

This is the part most families miss: your parent cannot be charged for the hospital or SNF stay while the Acentra Health review is active. The financial protection lasts from the moment you file until noon of the day after the QIO issues its decision.

This means there is virtually no financial risk to filing an appeal. The worst outcome is that the discharge proceeds one or two days later than planned.

When to Appeal a Skilled Nursing Facility Discharge

The same process applies when a skilled nursing facility says therapy is ending. If the SNF issues a Notice of Medicare Non-Coverage claiming your parent has "plateaued" in rehabilitation, you can file an immediate appeal with Acentra Health.

The legal standard under the Jimmo v. Sebelius settlement is clear: Medicare covers skilled nursing care for maintenance therapy, not just improvement. An SNF cannot terminate coverage simply because a patient is no longer making measurable progress — if skilled care is needed to maintain the patient's condition or prevent decline, Medicare should continue covering it.

How to Strengthen Your Appeal

When you call Acentra Health, be prepared to explain:

• What your parent cannot do safely — walking, transferring from bed to chair, managing medications, preparing food
• What has changed recently — new confusion, a fall within the last 48 hours, wound care needs, unstable vital signs
• What's missing at home — no one available to provide 24-hour supervision, stairs the patient cannot navigate, no access to physical therapy

You can also submit a written "caregiver perspective letter" to Acentra Health describing what you've observed at the bedside. The independent physician reviews this alongside the clinical chart.

The Second-Level Appeal
