How to Register an EPA in Northern Ireland: The OCP Process Step by Step

Your parent's EPA has been sitting in a drawer since they signed it. Now their memory is slipping, they are repeating themselves, and you are starting to manage their bills informally. That dormant document needs to be registered — and in Northern Ireland, registration is not optional once capacity starts declining.

Unlike England, where LPAs must be registered before they can be used at all, Northern Ireland EPAs only need registration when the donor begins losing mental capacity. But when that moment arrives, the attorney has a strict statutory duty to register. Using an unregistered EPA after capacity has declined is a legal offence.

When Registration Becomes Mandatory

The trigger is simple: the attorney has "reason to believe" the donor is becoming, or has become, mentally incapable of managing their property and financial affairs. This might be prompted by:

  • A formal dementia diagnosis
  • The donor making unusual financial decisions or forgetting to pay bills
  • A bank flagging concerns about the donor's cognitive state
  • A GP or consultant expressing concern about capacity

Once the attorney recognises capacity is failing, they must stop using the unregistered EPA for anything beyond essential daily expenses and begin the registration process immediately.

Step 1: Serve EP1 Notices

Before filing with the court, the attorney must serve Form EP1 (Notice of Intention to Register) on three groups:

The donor — delivered by hand, not by post. If the attorney believes notification would cause the donor serious clinical distress, they need a specific medical exemption before they can skip or delay this step.

Statutory relatives — served by first-class post. At least three relatives from the legal hierarchy: spouse or civil partner, then children, parents, siblings, nieces and nephews. If a category contains more than three people, every person in that category must receive notice.

Non-applying co-attorneys — if the EPA names joint and several attorneys but not all are applying, the others must be notified.

Step 2: File the EP2 Application

Once all EP1 notices have been served, the attorney submits the registration bundle to the Patients' Section of the Office of Care and Protection:

  • Completed Form EP2
  • The original signed EPA document
  • £189 registration fee (cheque payable to "NICTS")

The fee can be waived for donors on means-tested benefits, whose care is fully Trust-funded, or whose only asset is the family home.

Step 3: Wait 35 Days

The OCP holds the application for a mandatory 35-day waiting period, starting from the date the last EP1 notice was served. During this window:

  • Any notified person can lodge a formal objection
  • The attorney can pay for immediate necessities (food, utilities, existing care fees)
  • The attorney cannot sell property, liquidate investments, or execute major financial transactions

Step 4: Court Seals the Registration

If no objections are filed and the Master of the High Court is satisfied with the paperwork, the OCP registers the EPA and returns the sealed original to the attorney. The attorney now has full legal authority over the donor's financial affairs — including selling property, managing investments, and redirecting pensions.

What Goes Wrong

The most common problems that delay or derail registration:

  • EP1 served by post to the donor — this invalidates the notice; in-person service is mandatory
  • Incomplete relative notifications — missing even one sibling in a category can void the process
  • Submitting a photocopy instead of the original EPA — the OCP requires the physically signed document
  • Errors on the EPA itself discovered during review — incorrect signing order, missing witnesses, or wrong form used. If the underlying document is invalid, registration is refused and cannot be fixed without a new EPA (which requires capacity)

A rejected application means paying the £189 fee again, re-serving EP1 notices, and restarting the 35-day clock. Meanwhile, the donor's accounts may be frozen and care bills are accumulating.
