Power of Attorney Checklist for Aging Parents in Yukon

Before the Paperwork: The Family Conversation

The hardest part of this process is not the forms. It is the conversation where you ask a parent who has always managed their own affairs to plan for the possibility that they won't be able to. There is no way to make this comfortable, but there are ways to make it productive.

Start with the practical, not the emotional. Frame it around what happens if nobody has authority: the bank freezes accounts, bills go unpaid, the hospital selects a decision-maker based on a statutory hierarchy rather than your parent's preference. Most parents will engage once they understand that without documents, they lose control — not because they planned for it, but because they didn't.

Agree on two things before touching any forms: who should handle financial decisions (the EPA attorney) and who should handle healthcare decisions (the Advance Directive proxy). These can be the same person or different people. If siblings are involved, this is the conversation where disagreements surface. Better now than during a hospital crisis.

The Document Checklist

Yukon families need two core documents and several supporting pieces. Here is the complete list in execution order:

Document 1: Enduring Power of Attorney (EPA)

  • [ ] Download the current Yukon EPA form from yukon.ca (or use the December 2025 updated version)
  • [ ] Choose between immediate activation or springing activation (triggered by a specific event, typically a physician's incapacity certificate)
  • [ ] Name the attorney (must be 18+, not bankrupt, not a paid caregiver at the parent's facility)
  • [ ] Name an alternate attorney (in case the first attorney cannot or will not serve)
  • [ ] Decide scope: general (all financial affairs) or limited (specific powers only)
  • [ ] If choosing springing activation, specify the triggering condition clearly

Document 2: Advance Directive

  • [ ] Download the appropriate form — Abbreviated (proxy appointment and general preferences), Long Form (detailed values and medical scenarios), or Resuscitation and Care Form (end-of-life instructions only, does not name a proxy)
  • [ ] Name the proxy (must be 19+, or the maker's spouse/parent)
  • [ ] Name an alternate proxy
  • [ ] Document care preferences: treatment wishes, facility preferences, values that should guide decisions
  • [ ] Remember: MAiD cannot be requested through an Advance Directive

The Signing Day Checklist

Both documents require witnesses. Plan the signing session carefully:

For the EPA:

  • [ ] Arrange two witnesses aged 19+ who are NOT the attorney, alternate attorney, donor's spouse, any attorney's spouse, or anyone under a guardianship order — OR arrange a single lawyer
  • [ ] Print the Certificate of Witness form (if using two witnesses) or confirm the lawyer will prepare a Certificate of Legal Advice
  • [ ] Have government-issued photo ID ready for the donor
  • [ ] If there is any concern about the donor's cognitive state, arrange a same-day physician capacity assessment

For the Advance Directive:

  • [ ] Arrange two witnesses aged 19+ who are NOT the proxy or the proxy's spouse
  • [ ] The proxy must also sign the directive to accept the appointment (they do not need to be present at the same signing session as the maker and witnesses)

Capacity documentation (recommended for both):

  • [ ] If the parent has any cognitive concerns, have a physician provide a written capacity assessment on or close to the signing date
  • [ ] Keep a contemporaneous note of the parent's demeanour and understanding during signing

The Registration Checklist

Signed documents sitting in a drawer are not operational. The following registrations make them functional:

EPA registration:

  • [ ] Present the original EPA (with Certificate of Witness attached) to every bank where the parent holds accounts
  • [ ] Bring two pieces of government-issued ID (attorney and donor)
  • [ ] If springing: bring the activation documentation (physician certificate, Notice of Attorney Acting served)
  • [ ] Register with the CRA — either through the online "Represent a Client" portal (requires a RepID) or by submitting paper Form AUT-01
  • [ ] Register with Service Canada — Form ISP-1603 for communication access, or Form ISP-3505 for full pension administration if the parent is incapable

Advance Directive registration:

  • [ ] Submit the original or a copy to Yukon Insured Health Services (4th Floor, 204 Lambert St, Whitehorse) so it is flagged in the territorial health records
  • [ ] Provide copies to the parent's family doctor and local health centre
  • [ ] Provide copies to all named proxies

The Storage Checklist

  • [ ] Store originals in a fireproof safe or a secure location the attorney and proxy can access without delay
  • [ ] Do not store originals in a safety deposit box that requires the donor's signature to open — this creates a catch-22 during incapacity
  • [ ] Distribute copies to the attorney, proxy, all alternate appointees, and the parent's primary care physician
  • [ ] Keep a master list of every institution and person who holds a copy

Joint vs. Separate Attorneys

If appointing more than one child as EPA attorney, the donor must choose between joint (both must agree on every decision) and joint and several (either can act independently). Joint appointments provide a check against misuse but can paralyze decision-making if siblings disagree. Joint and several is faster but relies on trust between siblings.

For the Advance Directive, only one proxy is named (with an alternate). If siblings want shared input on healthcare decisions, the directive can include written instructions that the proxy must consult with named family members — but the legal authority rests with the proxy alone.
