If your parent is aging and you need legal authority over their finances, Northern Ireland gives you two routes: an Enduring Power of Attorney or a High Court Controllership Order. They are not alternatives you choose between freely — the route available to you depends entirely on whether your parent still has mental capacity.

The Key Distinction

An EPA can only be created while the donor has mental capacity. Controllership is the court-imposed process for when capacity has already been lost and no EPA exists.

If your parent can still understand what they are signing, you have the EPA option. Once that window closes, Controllership is the only path — and it is slower, more expensive, and heavily supervised.

What an EPA Gives You

Once registered with the Office of Care and Protection, an EPA attorney has broad authority over the donor's finances: managing bank accounts, paying care fees, redirecting pensions, selling property, and handling investments. There are no mandatory annual accounts to file and no court supervision fees — unless the OCP specifically directs it.

The entire process costs under £700 (including a solicitor for drafting), and registration takes about five to six weeks including the 35-day statutory waiting period.

What Controllership Demands

A Controllership Order grants similar financial authority, but under the court's constant watch. The Controller must:

  • Submit detailed annual vouched accounts to the OCP
  • Maintain a security bond (insurance policy protecting the estate)
  • Keep receipts for every transaction over £50
  • Get written OCP permission before spending £500 or more on a single item
  • Pay annual administration fees of £407 (funds outside court) or £570 (funds held by court)

The application itself requires a medical certificate of incapacity, character references, a comprehensive asset inventory, and proposed spending plans. Processing typically takes 4 to 12 months, during which the parent's bank accounts may be frozen.

Solicitor fees for a Controllership appointment start at £1,368 plus VAT (post-June 2025 rates). Annual accounts preparation adds £363 plus VAT each year.

Which Route Do You Need?

If your parent still has capacity — even borderline: act now and create an EPA. A dementia diagnosis does not automatically mean capacity is lost. If there is any doubt, arrange a GP assessment. The window to create an EPA can close suddenly after a stroke, fall, or rapid cognitive decline.

If your parent has already lost capacity and no EPA exists: Controllership is your only option. There is no shortcut — you must go through the OCP court process. However, if the estate is small or you only need to manage state benefits, a DfC Appointeeship (free, covers benefits only) or a Short Procedure Order (faster, simpler court route for low-value estates) may be sufficient.
