Caregiver Leave of Absence Letter Sample: Templates That Protect Your Job
Why the Written Request Matters More Than the Conversation
Under FMLA, notice may be oral or written; a hallway conversation is not automatically ineffective. If the employer has enough information to know that leave may be for a qualifying family medical reason, it generally must provide the Notice of Eligibility and Rights & Responsibilities (Form WH-381) within five business days, absent extenuating circumstances. A written follow-up is still valuable because it preserves what you reported and when. For an unforeseeable need, notify the employer as soon as practicable and follow the normal call-in procedure.
The key is the information you convey, not whether you use email. You don't need to use the words "FMLA" or cite statutes, but you should clearly state that you need leave to care for a family member with a serious health condition. A vague request for "personal time" or "some days off" may not give the employer enough information to evaluate FMLA coverage.
FMLA Leave Notification Letter
This template works for both continuous and intermittent leave requests. Send it to your HR department or designated leave administrator, and also follow any normal manager call-in procedure. A manager may receive legally sufficient notice, but centralizing the request creates a clearer record.
Subject: Written Notice of Need for Protected Family Caregiver Leave — [Your Name]
Dear [HR Contact / Leave Administrator],
I am writing to formally notify [Company Name] that I need to take job-protected leave to provide care for my [mother/father], who has a serious health condition requiring ongoing medical treatment and personal care assistance.
Based on the current treatment plan, I anticipate needing [continuous leave beginning approximately (date) / intermittent leave beginning approximately (date), estimated at (number) hours per week for medical appointments and care coordination].
I am submitting this request under the Family and Medical Leave Act and any applicable state family and medical leave statutes. Please provide the required Notice of Eligibility and Rights & Responsibilities (Form WH-381) and, if medical certification is required, the healthcare provider certification form (Form WH-380-F) and its submission deadline.
I would also appreciate guidance on the following:
- The company's policy on substituting accrued PTO to run concurrently with unpaid FMLA leave
- Procedures for maintaining my group health insurance premiums during the leave period
- Any state paid family leave benefits I should file for and how they coordinate with company benefits

What this letter does: It puts the qualifying reason on the record, requests the specific forms your employer must provide, and asks about benefits coordination — all in one communication. Save a copy with the sent timestamp.
State Paid Family Leave Request
If you're in a state with a paid family leave program, you'll file separately with the state agency (not your employer) for wage replacement benefits. But you should also notify your employer, because many states require employer cooperation in the application process.

Dear [HR Contact],
I am writing to inform you that I will be filing a claim for [state] Paid Family Leave benefits to care for my [parent] beginning on or about [date]. I understand that this claim may run concurrently with my FMLA leave.
Please provide any employer attestation forms required by the state program and confirm whether the company's benefits allow for "top-off" supplementation of state benefits with accrued PTO.

Filing deadlines vary by state. California requires filing within 41 days of the start of leave. New Jersey requires filing within 30 days. Missing these windows can result in benefit denial, so check your state's requirements and file promptly.

Personal Leave Request (When FMLA Doesn't Apply)
If your employer does not employ 50 employees within 75 miles of your worksite, or if you haven't met the 12-month / 1,250-hour eligibility thresholds, FMLA may not cover you. You'll need to request personal leave under your company's own policies or check whether state law provides another route.

I am requesting a [duration] personal leave of absence beginning [date] to manage a family health situation that requires my direct involvement.
During my absence, I propose the following coverage plan: [brief description of handoff arrangements, project status, and point of contact for urgent matters].

This request doesn't carry FMLA's legal protections, but having it in writing still matters. It establishes that your employer was aware of the reason for your absence — relevant if you later need to argue that any adverse action was retaliatory.
Common Mistakes to Avoid
Don't bury the reason. "I need some time off for personal matters" may not give the employer enough information to evaluate FMLA coverage. "I need leave to care for my parent who has a serious health condition" does. You don't have to share the diagnosis, but the qualifying reason should be clear.
Don't skip the follow-up email. If your initial conversation was verbal, send an email afterward: "Per our discussion today, I'm formalizing my request for FMLA leave to care for my parent. I'll expect the WH-381 eligibility notice within five business days."
Don't forget to track your leave separately. Your employer tracks leave in their payroll system, but you should keep your own record of hours taken, dates, and the reason for each absence. If there's ever a dispute about whether you exceeded your FMLA allotment, your records are your defense.
